Section “Binding individual arbitration” requires most disputes to be resolved individually through binding arbitration and includes jury-trial and class-action waivers. You may opt out within 30 days as described below.
Provider and agreement
“Wallops Watch,” “we,” and “us” mean the individual owner/operator doing business under the Wallops Watch name. Wallops Watch is currently a trade name, not a corporation or limited-liability entity. By creating an account or otherwise using the service, you agree to these terms.
Eligibility
You must be at least 13 years old to create an account or subscribe. If applicable law requires a higher age for independent consent, a parent or guardian must authorize your use.
Independent informational service
Wallops Watch is an independent project and is not affiliated with, sponsored by, or endorsed by NASA. Schedules, viewing conditions, events, and assistant answers may be incomplete, delayed, or incorrect. Always confirm time-sensitive information with the linked official source before traveling or making plans.
Accounts and acceptable use
You are responsible for protecting your account and providing accurate information. Do not probe the production service, bypass access controls or rate limits, upload malicious content, impersonate another person, interfere with availability, scrape excessively, or use the service unlawfully. Security testing is allowed only in a separately authorized training environment or with prior written permission.
AI assistant
The assistant is informational, read-only, and may produce an inaccurate or unsupported response. It cannot modify accounts or publish content. Do not submit confidential, sensitive, or personal information in questions.
Intellectual property and external content
The Wallops Watch name, interface, and original code or content are protected as applicable. NASA and third-party names, imagery, media, and links belong to their respective owners and are used for attribution and informational purposes. External services have their own terms.
Availability and termination
We may modify, suspend, or discontinue features and may restrict accounts that violate these terms or threaten users or the service. We do not promise uninterrupted availability.
Disclaimer and limitation of liability
The service is provided “as is” and “as available” to the fullest extent permitted by law, without warranties of accuracy, availability, fitness for a particular purpose, or non-infringement. Wallops Watch does not provide operational, safety, travel, legal, or emergency guidance. To the fullest extent permitted by law, Wallops Watch and its owner/operator will not be liable for indirect, incidental, special, consequential, exemplary, or reliance-based damages, lost data, lost opportunities, or losses arising from schedule changes or third-party content. Rights and liabilities that cannot legally be limited remain unaffected.
Informal dispute resolution
Before filing arbitration or a lawsuit, the claimant must email hello@wallopswatch.com with the claimant’s name, account email, facts, and requested relief. The parties will attempt in good faith to resolve the matter for 30 days after receipt. Limitation periods are tolled during that period where permitted by law.
Binding individual arbitration
Except for an eligible individual claim in small-claims court or a request for urgent injunctive relief concerning misuse, security, or intellectual property, any dispute arising from these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its then-current Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration provision. The arbitrator may award relief available to the individual under applicable law, but only as necessary for that individual claim.
No class actions or jury trials. You and Wallops Watch waive trial by jury and agree to bring claims only in an individual capacity, not as a plaintiff, claimant, or class member in a class, collective, consolidated, representative, or private-attorney-general proceeding. If this waiver is finally found unenforceable for a particular claim or remedy, that portion will proceed in a court of competent jurisdiction after all arbitrable matters are completed.
Hearings may occur by video, telephone, documents, or at a reasonably accessible location as the applicable rules permit. Fees will be allocated under the AAA Consumer Rules, except Wallops Watch will pay amounts the law or those rules require it to pay. If AAA cannot administer the matter, the parties will select another comparable provider or a court will appoint one.
Thirty-day arbitration opt-out
You may opt out of the arbitration and class-waiver provisions by emailing hello@wallopswatch.com within 30 days after first accepting these terms. Include your full name, account email, and the statement “I opt out of arbitration.” Opting out will not affect your account or the remaining terms.
Governing law
These terms are governed by Delaware law, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs arbitration and mandatory consumer protections of your home jurisdiction remain applicable where they cannot lawfully be waived. Court proceedings permitted under these terms must be brought in a court with lawful jurisdiction.
